How and where can I sue someone who hacked my Facebook account?

First of all you need to look at your civil code book ( the one in accordance to your location. eg : Germany has Bürgerliches Gesetzbuch , the BGB )

You will then need to look at the sections or paragraphs that specify the actions of cyber bullying and its consquences.

From there, you go to your local court and write a claim against the person who cyber bullied you with your evidence supporting your claim such as screen shots, emails and messages ( you must have his name, adress...etc )

Oh! God,  that's really terrible matter. You can report him to Facebook or call the police to take legal action. 

However,  there are many important  points to bear in mind :

1- Whenever someone brings suit against another, they are seeking damages. If you do not have any substantiated damages, there is no basis for the claim. 2-Anything on that FB account is considered PUBLIC RECORD, and anyone can use your pics, authority can impose action against a particular comment, and all OF OUR Civil rights are out the door, basically, when we use FB app. We have no rights to privacy, freedom of speech, etc. when it comes to online social group activities. 3-Concerning criminal charges being brought against the person, you would have to provide necessary proof that your personal identity has been threatened by that person, or file stalker/harassment charges on them, especially since they are coming onto your property to place those copies of your IMs. On short if I have the same problem I wouldn't immediately call the police without touch the evidence. But if I have proof and certain person fakes me,  so I would go immediately to police so Fingerprints can be lifted from the paper for the proof I need that THAT person is harassing me and using my identity on FB.

This is a Cyber crime comes under Cyber Penal Laws. Therefore you need to collect all material with regard to the instances how do you think it is hacked and what way it was misused and go to your nearest (local jurisdiction's) police station who deals with Cyber crime cases and report FIR to them with the details collected by you in written and take a acknowledgement from them as well. At the same time co-operate with the police for investigation in the matter to find out the truth and to nab the culprit. My 2 cents. Thanks.

This kind of an illegal act is  of criminal nature.It is one of those crimes called e- crimes or cyber crimes

 In this case, and because it is a criminal act you have to submit a complaint to the public prosecution or at least the nearest police station so as to protect yourself and your own propety

The procedures for the same is to submit a petition to the public prosecution in the area in which the crime occured, clarfiying the date and kind of infringement  asking for taking the necessary actions and decisions. You can also ask for a compensation on the basis of damages happened to you.

In some countries there is a specialzed police and specialized courts for this type of crimes.If this is in not available in your country ,you can submit your complainat along with all legal reports to the competent criminal court through the public prosecution bureau or police station.

 You may report this incident to the police or any authority who  may help you through Facebook administrator to know from where the account has been hacked . Then it should be enquired through investigating agencies as to who hacked the account .Then as per of the law of the land where the account was hacked you may file a suit against infringement of right of your privacy in the court under  whose jurisdiction the account was hacked and claim damages showing your evidences such as print out . screen shots , emails and you may also request the investigating agencies to provide other relevant evidences.

The answer to the first part of the question on how to sue is by:

1. Go to the nearest police station and report the crime and if you know the perpetrator include it in the so-called police blotter;

2. if you have an attorney/counsel, ask him/her to file a complaint-affidavit for the crime committed and file it with the Office of the Prosecutor/or in other countries District Attorney's Office and follow the procedures as per instruction;

NOTE that this is a felony or a crime in violation of a special law (if there is a cyber law passed or imposed in your country) and does not require intent or intent to gain or damage.  The mere fact that the violation is committed, it is likely to be elevated in the court.   this is also a violation of a person's privacy which may be under another criminal felony or special law.

NOW, the question where to sue depends on whether this is a question of jurisdiction. if it is a question of jurisdiction, then it should be filed where the crime was committed as this is a criminal act, the location where the crime was committed overrides other jurisdiction.  However, please do not forget that this is a cyber crime and jurisdiction is flexible and most of the time depends on the complainant/victim where he/she is most convenient.  Now, establishing the jurisdiction we go to where to file as a procedure.  Number 2 above is one of the choices where to file.  However, it is most of the time depends on the country where you are at or where you decided to file.  There are countries/jurisdiction that instead of filing first with the Prosecutor/DA it is filed with the court and the count assigns to a DA or prosecutor.  There are also countries/jurisdictions where special courts such as cyber crime courts are established and it is only there and only there crimes such as this is filed.

THUS, it is advisable that if you want to file such a violation, either you make a full research on how it is done in the country you wish to do so or find and locate a decent lawyer/barrister to file the same for you and provide you good advice.
