A supplies goods to B under a Contract. B returns goods in violation of contract. whether A should file suit for specific performance OR for damages?

Assalam Alaikum,

 

The answer lies in the nature of goods supplied. If the goods are perishable or irreversible(inablity to sustain original form) then the specific performance can be enforced and in other case damages fulfill the suits normally. Although it is purely a case specific question in which the honorable court has to decide. But as a lawyer we should intelligently go for specific performance because damages can anyway be a last resort to seek.
