Explain briefly the FIDIC regulations about the role of the Engineer, namely, the terms involving the Designing Engineer of a dam project ?

<p>During the construction period, where the supervision of Construction has been assigned to a different Consulting Engineer, Please note that the International Commission of Large Dams guidlines were significantly involved during construction to ensure that the design intent was met. </p>

  Thank you my dear brother ,,,,, In the The FIDIC Contracts Guide CONDITIONS OF CONTRACT FOR CONSTRUCTION & CONDITIONS OF CONTRACT FOR PLANT AND DESIGN-BUILD & CONDITIONS OF CONTRACT FOR FOR EPC/TURNKEY PROJECTS First Edition2000 3.1 Engineer’s Duties and Authority Clause3 CONS/P&DB The Engineer EPCT The Employer’s Administration The Employer shall appoint the Engineer who shall carry out the duties assigned to him in the Contract. The Engineer’s staff shall include suitably qualified engineers and other professionals who are competent onsto carry out these duties. The Engineer shall have no authority to amend the Contract. The Engineer may exercise the authority attributable to the Engineer as specified in or necessarily to be implied from the Contract. If the Engineer is required to obtain the approval of the Employer before exercising a specified authority, the requirements shall be as stated in the Particular Conditions. The Employer undertakes not to impose further constraints on the Engineer’s authority, except as agreed with the Contractor. However, whenever the Engineer exercises a specified authority for which the Employer’s approval is required, then (for the purposes of the Contract) the Employer shall be deemed to have given approval. Except as otherwise stated in these Condition :                                  

(a) whenever carrying out duties or exercising

authority, specified in or implied by the

Contract, the Engineer shall be deemed to

act for the Employer;

(b) the Engineer has no authority to relieve either

Party of any duties, obligations or responsibilities under the Contract; and

(c) any approval, check, certificate, consent,

examination, inspection, instruction, notice,

proposal, request, test, or similar act by the

Engineer (including absence of disapproval)

shall not relieve the Contractor from any

responsibility he has under the Contract,

including responsibility for errors, omissions,

discrepancies and non-compliances.

Ultra qualified science and technology, the construction engineer is a framework that works as a team, making decisions and assume responsibilities within a business. Its mission is to develop the .infrastructure of a region or a country. He designed bridges, dams, buildings, roads

The construction engineer must show a strong sense of human contact but also negotiating skills because he has to work in harmony with the service studies as with the foreman. It is useful to have some business skills, inventiveness, ease to communicate and work in teams and rigor. The construction engineer must be able to make it available. This is both a man of education and action.

Rigor and anticipation

Nothing should escape him: the geographic data of a site, but also economic, human, social and even political. The construction engineer has a capacity to anticipate and analyze the sites. He stands informed about news and recent legislation. One of its main objectives: develop the environment to protect people and the existing infrastructure of natural disasters. He must be very vigilant in making, for example, the decision to build a dam. It is important to be mobile and to master English.

Technical knowledge

The construction engineer must have technical skills (knowledge of the material ...), analytical capabilities, the sense of anticipation and organization. It must show great scientific rigor, and be able to have a global view of a project. His work sometimes requires control of computer-aided design (CAD) software, which allow you to perform simulations.

The FIDIC contracts usually involve "the Engineer", who has a defined role to play during construction - and we assume this is the "different Consulting Engineer" referred to. The "Designing Engineer" could be an engineer engaged by the Employer just to design the Works (with the other Engineer taking over to supervise the Works during construction) - or he could be an engineer engaged by the Contractor if it is a design-build or turnkey type project. In the first case, presumably he would be engaged under the FIDIC White Book (or something similar) and his terms of reference under that should define his role (if any) during the construction period. In the second case (if he is engaged by the Contractor), he will presumably be considered to be a part of the Contractor's organisation carrying, in effect, the Contractor's responsibilities in the Contract for design.

FIDIC also runs a bookshop and publishes international contracts and business practice documents which are used as guides and templates the world over, where you can find the current regulations for each country not only for dam building.

FIDIC is best known for its range of contracts that includes the: Dredgers Contract; Short Form of Contract; Construction Contract; Plant & DB Contract; DBO Contract; and EPC/Turnkey Contract. Details are available in the FIDIC Bookshop. FIDIC also publishes the Client/Consultant Model Services Agreement together with the Sub-Consultancy Agreement and the Joint Venture Agreement. FIDIC publishes the MDB Harmonised Edition of the Construction Contract that is used by Multinational Development Banks including the World Bank for their projects.

The Engineer is nominated by the Employer.  Certain powers, beyond those specifically defined by the contract terms are then delegated to them by the Employer.  These terms are outlined in their letter of delegation.  You will also need to define the powers of other stake holders such and the Employers representative and the employers representatives consultant.

The FIDIC engineer is responsible for contract administration on behalf of Employer, have no right to change the design, shall follow the design and refer to Design Engineer each time there is a such a need. Design engineer helps assure the Employer that completed building will reflect the intend design.
