When mistake (in Quantity or description) is found in the BoQ, can it be a variation order which give rise to cost implication to a contract?

If the binding agreement between the Principal Sponsor/Client and the Contractor states that quantity should be remeasured as per site progress prior to the application of monthly payment then the contractor can claim the extra or excess quantity through variation order. But if it is a lumpsum contract then you cannot claim beyond your contract quantity. You are lucky if the client agree to pay you the said mistake in BOQ in the lumpsum contract.

No it can not , only changes of drawings or specifications made by client after signing the contract can be variation ..

When mistake in B.O.Q, we check the contract type if it is lump sum amount contract, then no variation shall be considered, but for construction contract variation is added in case B.O.Q precedes specification and drawings

It depends on the types of contract. For construction contract without quantities - normally is called lump sum contract (based on drawing and specification where BoQ may just be used to derive the tender sum), mistake in the BoQ cannot give rise to variation order.For construction contract with quantities, mistake in description within BoQ can give rise to variation order provided BoQ has higher precedence than the Contract Drawings and Specification within the Contract document. For substantial mistake in the quantity within the BoQ, it will be corrected and dealt with as an variation order.

It depend on the condition of contract.

 

In general, The Mistake in Quantity or description of the item in B.O.Q. will not be considered as variation order. The Tendering Procedure to carefully check the quantity and description and the specification of the specific item of the B.O.Q.

For a mistake in the quantity in a priced BOQ it can't be a variation order but for some major changes and high percentages it can be claimed and mainly on time impacts not cost .. for the description mistake it could be covered in the standards or the scope of work and here the contract give the priorities for these documents .. it can be a variation only if missing in the BOQ description and not mentioned in these other documents

Yes ,It can be accepted  depending on the time frame giving for contactors to respond to the BOQ. I have such experiences in some of my Projects.While at the same time It will be well stated right from time that there is no variation and enough time line is giving for your response  and fund is provided for quick execution of project. so no excuse if you make mistake.

Also depends on Design engineers drawings clarity.
